Welcome to Uniwear. These Terms & Conditions (“Terms”, “Terms and Conditions”) govern your access to and use of the Uniwear website, uniwear.online (“Website”), and the purchase of products through the Website.
By accessing, browsing, registering on, or purchasing products through the Website, you acknowledge that you have read, understood, and agreed to be bound by these Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policies published on the Website.
If you do not agree with these Terms, please do not use the Website or place an order through it.
1. ABOUT UNIWEAR
Uniwear is a retail clothing business operating as a sole proprietorship, owned/proprietored by Vivek Rochwani.
Uniwear has more than 20 years of experience in the clothing retail business and offers clothing products to customers in India through its physical retail operations and online channels.
The Website is operated for the sale of physical clothing products.
Uniwear currently offers online products including applicable men’s clothing products such as T-shirts, kurtas and sherwanis, together with such other products as may be introduced on the Website from time to time.
Uniwear reserves the right to add, modify, discontinue, or restrict products offered through the Website at any time.
2. DEFINITIONS
For the purposes of these Terms:
“Uniwear”, “we”, “us”, or “our” means the Uniwear business operated by Vivek Rochwani.
“Customer”, “you”, or “your” means any person who accesses the Website or purchases products from Uniwear.
“Product” means any physical clothing product displayed or offered for sale through the Website.
“Order” means a request submitted by a Customer to purchase one or more Products through the Website.
“Website” means uniwear.online and any related online pages, interfaces, or digital services operated by Uniwear.
3. ELIGIBILITY TO USE THE WEBSITE
By using the Website or placing an Order, you represent that:
- The information provided by you is accurate and complete.
- You have the legal capacity to enter into a binding transaction under applicable law.
- You will use the Website only for lawful purposes.
- You will not use the Website to conduct fraudulent, abusive, or unlawful activities.
Where a person below the legally applicable age accesses or purchases through the Website, such activity should be undertaken with the knowledge and involvement of a parent or legal guardian.
Uniwear reserves the right to refuse or cancel transactions where there is reasonable evidence of fraudulent, unlawful, or abusive activity.
4. WEBSITE INFORMATION AND PRODUCT DESCRIPTIONS
Uniwear makes reasonable efforts to ensure that product descriptions, photographs, specifications, colours, sizes, prices, and other information displayed on the Website are accurate.
However:
- Actual colours may vary depending on the Customer’s screen or device.
- Minor differences in appearance may occur between photographs and the actual Product.
- Product measurements may have reasonable manufacturing variations.
- Product availability may change without prior notice.
- Product images may contain styling or presentation elements that are not included with the Product.
Uniwear does not intentionally provide misleading information. If a Product is materially different from its description or is defective or incorrect, the Customer may contact Uniwear in accordance with the applicable return, replacement, and refund policy.
5. PRODUCT AVAILABILITY
All Products are subject to availability.
Adding a Product to a shopping cart does not guarantee that the Product will remain available until checkout or payment.
Uniwear reserves the right to limit quantities, discontinue Products, or restrict availability for particular locations or customers where reasonably necessary.
If an Order is accepted but the Product subsequently becomes unavailable, Uniwear may cancel the affected Order and provide an applicable refund for any amount already paid.
6. PRICES
Product prices displayed on the Website are stated in Indian Rupees (INR) unless otherwise specified.
Uniwear makes reasonable efforts to maintain accurate pricing information. However, typographical, technical, inventory, or pricing errors may occasionally occur.
Where an obvious pricing error occurs, Uniwear reserves the right to cancel the affected Order and refund any amount paid for that Order.
Applicable delivery charges, COD charges, or other charges, where applicable, will be displayed during the ordering process.
Uniwear reserves the right to change prices at any time. Price changes will not ordinarily affect Orders that have already been accepted and confirmed, except where cancellation is required due to an obvious error or circumstances beyond Uniwear’s reasonable control.
7. TAXES
Uniwear currently operates without GST registration, as applicable to its present business status.
If applicable taxes or statutory charges become payable due to a change in Uniwear’s registration status, applicable law, or the nature of a transaction, the relevant charges will be handled in accordance with applicable law.
Uniwear reserves the right to update tax-related information when its legal or registration status changes.
8. ORDER PLACEMENT
Customers may place Orders through the purchasing functionality made available on the Website.
When placing an Order, you are responsible for ensuring that:
- Your name is accurate.
- Your mobile number is correct.
- Your email address is correct, where applicable.
- Your shipping address is complete and accurate.
- Product size, colour, quantity, and other selections are correct before placing the Order.
Uniwear is not responsible for delays or failed delivery caused by incorrect, incomplete, or inaccurate information supplied by the Customer.
9. ORDER CONFIRMATION
Submitting an Order constitutes a request to purchase the selected Products.
An Order is subject to acceptance and availability.
Uniwear may verify an Order before processing it, particularly where there are concerns relating to incorrect information, unusually large quantities, suspected fraud, payment problems, or COD-related risk.
Order confirmation does not prevent Uniwear from cancelling an Order where cancellation is reasonably necessary under these Terms or applicable law.
10. PAYMENT METHODS
Uniwear may provide one or more of the following payment methods:
- UPI
- Credit and debit cards
- Other online payment methods made available through the Website
- Cash on Delivery (where available)
Payment options may vary depending on the Customer’s location, Order value, Product, courier availability, or other operational considerations.
Online payments may be processed through third-party payment service providers. Uniwear does not store complete payment-card information unless expressly stated otherwise and permitted by applicable law.
Customers must not use fraudulent payment methods or payment instruments belonging to another person without lawful authorization.
11. CASH ON DELIVERY
Cash on Delivery (“COD”) may be available for eligible Orders and locations.
Uniwear reserves the right to restrict or discontinue COD availability for particular Customers, locations, Products, or Order values.
Customers placing COD Orders are expected to accept and pay for genuine Orders placed by them.
Repeated refusal to accept COD Orders, placing fraudulent COD Orders, intentionally providing false information, or abusing the COD facility may result in restriction or cancellation of future COD orders and/or other appropriate action permitted by law.
Any such action will not affect statutory consumer rights where applicable.
12. CANCELLATION BY THE CUSTOMER
Customers may request cancellation of an online Order before the Order has been shipped.
Once an Order has been shipped, cancellation may no longer be possible through the normal cancellation process.
If cancellation is successfully processed before shipment, the applicable refund will be made according to the payment method and Uniwear’s Refund Policy.
Customers should contact Uniwear as soon as possible if they wish to cancel an Order.
13. CANCELLATION BY UNIWEAR
Uniwear may cancel an Order, in whole or in part, where reasonably necessary, including because of:
- Product unavailability;
- Inventory errors;
- Incorrect or obvious pricing errors;
- Inaccurate customer information;
- Payment failure;
- Suspected fraudulent or abusive activity;
- Delivery restrictions;
- Repeated COD refusal or misuse;
- Technical or operational errors; or
- Circumstances beyond Uniwear’s reasonable control.
Where a prepaid Order is cancelled by Uniwear and the Customer is entitled to a refund, the applicable amount will be refunded in accordance with the Refund Policy and applicable law.
14. SHIPPING AND DELIVERY
Uniwear currently provides delivery within India.
The standard estimated delivery period is generally 3 to 7 business days, subject to location, courier availability, product availability, operational conditions, and other circumstances beyond Uniwear’s reasonable control.
The delivery estimate is an expected timeframe and not an absolute guarantee.
Delivery may be delayed due to:
- Weather conditions;
- Natural disasters;
- Transportation disruptions;
- Courier delays;
- Incorrect address information;
- Public holidays;
- High-demand periods;
- Government restrictions;
- Operational disruptions; or
- Other circumstances beyond reasonable control.
Uniwear will make reasonable efforts to assist customers with delivery-related issues.
15. SHIPPING CHARGES
Shipping is currently free for Orders above ₹699, subject to any applicable conditions displayed on the Website.
For Orders below the applicable free-shipping threshold, shipping charges may apply and will be displayed during checkout or otherwise communicated before completion of the Order.
Uniwear reserves the right to change shipping charges and thresholds prospectively.
16. DELIVERY ATTEMPTS AND CUSTOMER RESPONSIBILITY
Customers must provide an accurate and complete delivery address and remain reasonably available to receive the Order.
If delivery fails because:
- the address is incorrect or incomplete;
- the recipient is unavailable;
- the Customer refuses delivery;
- the Customer does not respond to the courier;
- the Customer refuses a legitimate COD Order; or
- other circumstances attributable to the Customer prevent delivery,
Uniwear may take appropriate action, including cancellation or restriction of future COD facilities.
Any refund in such circumstances will be handled according to the applicable Refund Policy and applicable law.
17. RETURNS
Uniwear provides returns subject to the eligibility requirements stated in its Refund and Return Policy.
Unless a Product-specific exception is displayed, eligible Customers may request a return within 7 days of delivery.
A return request must satisfy the applicable eligibility conditions.
Products purchased through the Website must generally be returned:
- Unused;
- Unwashed;
- In original condition;
- With original tags attached;
- With the original bill/invoice or other required proof of purchase; and
- In original or suitable packaging where reasonably required.
Uniwear may reject a return where the Product does not satisfy the applicable return conditions.
18. NON-RETURNABLE PRODUCTS
The following Products are not eligible for return where specifically identified as non-returnable:
- Products expressly marked as non-returnable on the Website;
- Products purchased as part of eligible sale or discounted pricing, where the applicable offer states that such Products are non-returnable;
- Products purchased through bulk orders;
- Products that have been used, washed, damaged, altered, stained, or otherwise changed after delivery;
- Products returned without required tags or proof of purchase;
- Products that do not satisfy the stated return conditions.
Where a Product page or promotional offer contains a specific return restriction, that restriction will apply subject to applicable consumer law.
19. SALE AND DISCOUNTED PRODUCTS
Products sold under a sale, clearance, promotional, or discounted offer may be designated as non-returnable.
The applicable return condition will be displayed or communicated as part of the relevant offer wherever reasonably practicable.
A discount or promotional price does not remove any mandatory statutory rights relating to defective, damaged, incorrect, or otherwise legally non-conforming Products.
20. BULK ORDERS
Products purchased through bulk or special-volume Orders are generally not eligible for the standard return policy.
Bulk Orders may be subject to separately agreed commercial terms.
Customers placing bulk Orders should review quantities, sizes, Products, and other specifications carefully before confirming the Order.
21. DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS
If a Customer receives a Product that is:
- Defective;
- Damaged in transit;
- Incorrect;
- Different from the Product ordered; or
- Otherwise materially inconsistent with the confirmed Order,
the Customer should contact Uniwear as soon as reasonably possible after delivery.
Uniwear may request photographs, videos, packaging information, the invoice, tags, or other information reasonably necessary to investigate the issue.
Where the claim is verified, Uniwear will provide an appropriate remedy, which may include replacement, exchange, refund, or another remedy required or permitted by applicable law.
Nothing in these Terms limits statutory rights relating to defective or deficient goods.
22. FREE RETURN PICKUP
For eligible returns, Uniwear may provide free return pickup from the Customer’s delivery address.
The availability of return pickup may depend on serviceability of the Customer’s location and courier availability.
Uniwear does not ordinarily refund the original delivery/shipping charge merely because a Customer chooses to return an eligible Product.
Where a refund is legally or contractually required due to a wrong, defective, or damaged Product, the applicable refund will be handled in accordance with the Refund Policy and applicable law.
23. REFUNDS
Where a refund is approved, the Customer will generally receive the Product price paid for the eligible returned Product.
Original delivery charges are generally non-refundable for voluntary returns.
Refunds will ordinarily be processed to the original payment method, subject to payment-provider procedures and applicable law.
Refund processing times may vary depending on the payment method, banking institution, payment gateway, and other third-party processing timelines.
Uniwear will not be responsible for delays caused solely by banks, payment gateways, card issuers, or other third-party financial institutions.
24. EXCHANGE AND REPLACEMENT
Where an exchange or replacement is applicable, it will be subject to Product availability and the relevant policy conditions.
Wrong or defective Products will be addressed through an appropriate exchange, replacement, refund, or other legally applicable remedy.
Uniwear does not guarantee that an identical replacement size, colour, or Product will always be available.
Where the requested replacement is unavailable, an alternative remedy may be offered in accordance with applicable law and the relevant policy.
25. RETURN INSPECTION
All returned Products may be inspected before a return, refund, or exchange is approved.
Uniwear reserves the right to reject a return where the Product:
- Shows signs of use;
- Has been washed;
- Has been altered or damaged;
- Is missing original tags;
- Is materially different from the Product originally delivered;
- Was purchased under a non-returnable category; or
- Otherwise fails to meet the applicable return conditions.
This inspection process does not limit any statutory consumer rights.
26. WARRANTY
Unless expressly stated on a Product page or invoice, Uniwear does not provide a separate manufacturer warranty for clothing Products.
Where a manufacturer or brand warranty applies to a particular Product, the applicable warranty terms will be those provided by the relevant manufacturer or brand.
Nothing in these Terms excludes any warranty, guarantee, or statutory right that cannot lawfully be excluded.
27. PROMOTIONS, DISCOUNTS AND COUPONS
Uniwear may offer promotional campaigns, discounts, coupon codes, festival offers, or other promotional benefits from time to time.
Unless expressly stated otherwise:
- Promotions are subject to availability;
- Promotions may have specific eligibility requirements;
- Promotions may have an expiry date;
- Certain Products may be excluded;
- Promotional benefits may not be combined;
- A promotion may be withdrawn or modified prospectively; and
- Promotional Products may have different return conditions.
Uniwear reserves the right to cancel transactions involving fraudulent or abusive use of promotional offers.
28. INTELLECTUAL PROPERTY
All intellectual property appearing on the Website, including where applicable:
- Uniwear branding;
- Logos;
- Trade names;
- Text;
- Product descriptions;
- Graphics;
- Photographs;
- Videos;
- Website design;
- Layout;
- Software; and
- Other original Website content
is owned by, licensed to, or otherwise lawfully used by Uniwear and is protected under applicable intellectual-property laws.
Customers may access and use the Website for personal, lawful shopping purposes.
No Customer may reproduce, copy, modify, distribute, sell, publish, commercially exploit, or create derivative works from Uniwear’s intellectual property without prior written permission, except where permitted by applicable law.
29. USER REVIEWS AND CONTENT
Where the Website allows customers to submit reviews, ratings, photographs, comments, or other content, Customers must ensure that such content is truthful, lawful, and not misleading.
Customers must not submit content that:
- Is fraudulent or deceptive;
- Infringes another person’s intellectual-property rights;
- Contains unlawful, threatening, abusive, obscene, or defamatory material;
- Contains malicious software;
- Contains another person’s personal information without authorization;
- Is unrelated to the Product or Customer experience; or
- Is intended to manipulate ratings or reviews.
Uniwear reserves the right to remove or restrict content that violates these Terms or applicable law.
By voluntarily submitting content to the Website, the Customer grants Uniwear a non-exclusive, royalty-free right to use, reproduce, display, and publish that content for legitimate business and promotional purposes, subject to applicable law and the Customer’s rights.
30. ACCEPTABLE USE
You agree to use the Website only for lawful purposes.
You must not:
- Attempt to gain unauthorized access to the Website or its systems;
- Introduce malware, viruses, or harmful code;
- Interfere with Website functionality;
- Scrape or systematically extract Website data without authorization;
- Create fraudulent accounts or Orders;
- Use stolen payment information;
- Abuse COD facilities;
- Attempt to manipulate prices, promotions, reviews, or Website functionality;
- Use the Website to violate any applicable law; or

Nothing in these Terms is intended to deprive a Customer of rights available under applicable consumer-protection law.
37. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Uniwear, its owner, employees, representatives, service providers, and partners from claims, losses, liabilities, costs, or expenses arising from:
- Your unlawful use of the Website;
- Your violation of these Terms;
- Fraudulent activity associated with your account or Orders;
- Your infringement of third-party rights; or
- Your intentional misuse of the Website.
This provision does not require a Customer to indemnify Uniwear for losses caused by Uniwear’s own unlawful conduct.
38. FORCE MAJEURE
Uniwear will not be responsible for failure or delay in performing its obligations where the failure or delay results from circumstances beyond its reasonable control.
Such circumstances may include:
- Natural disasters;
- Floods;
- Fires;
- Epidemics or pandemics;
- War;
- Terrorist incidents;
- Government restrictions;
- Strikes;
- Transportation disruptions;
- Internet or telecommunications failures;
- Courier disruptions;
- Payment-system failures;
- Power failures; or
- Other events beyond reasonable control.
Uniwear will make reasonable efforts to resume affected services when circumstances permit.
39. FRAUD AND ABUSE
Uniwear takes fraudulent transactions and abuse of its services seriously.
Where reasonably justified, Uniwear may investigate or restrict transactions involving:
- Fraudulent payment activity;
- Repeated fraudulent COD Orders;
- False return claims;
- Abuse of refunds or replacements;
- Promotional-code abuse;
- Multiple accounts created to circumvent restrictions;
- Misuse of the return system;
- Deliberate damage or misuse of Products; or
- Other unlawful or abusive activity.
Any action taken will be subject to applicable law and will not unlawfully restrict statutory consumer rights.
40. CHANGES TO THESE TERMS
Uniwear may update these Terms from time to time to reflect changes in:

- Business practices;
- Technology;
- Legal or regulatory requirements; or
- Customer-service processes.

Nothing in these Terms is intended to prevent a Customer from exercising any mandatory rights or remedies available under applicable Indian consumer-protection law.
42. DISPUTE RESOLUTION
Uniwear encourages Customers to contact customer support first so that complaints can be reviewed and resolved efficiently.
Where a dispute cannot be resolved through customer support or the applicable grievance process, the parties may explore an appropriate dispute-resolution mechanism, including mediation where appropriate.
Nothing in these Terms prevents a consumer from approaching an appropriate consumer dispute redressal authority or exercising any statutory right available under applicable law.
Subject to applicable consumer-protection laws and jurisdictional requirements, courts having appropriate jurisdiction in Bengaluru, Karnataka, India may have jurisdiction over disputes relating to these Terms.
43. CONSUMER RIGHTS
Nothing in these Terms is intended to:
- Exclude statutory consumer rights;
- Restrict a consumer’s legal remedies;
- Permit unfair trade practices;
- Exclude mandatory statutory warranties or guarantees;
- Prevent a consumer from approaching an appropriate consumer authority; or
- Override any provision of applicable Indian law.
Where any provision of these Terms conflicts with a mandatory provision of law, the mandatory legal provision will prevail to the extent of the conflict.
The Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020, as amended or replaced from time to time, apply to the extent applicable to Uniwear’s business and transactions.
44. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permissible, and the remaining provisions will continue in effect.
45. WAIVER
Failure by Uniwear to enforce any provision of these Terms at any particular time does not constitute a waiver of its right to enforce that provision in the future.
46. ENTIRE AGREEMENT
These Terms, together with the applicable Privacy Policy, Refund/Return Policy, Shipping Policy, and other policies expressly incorporated into the Website, constitute the terms governing your use of the Website and purchase of Products from Uniwear.
Product-specific terms displayed on the Website may apply in addition to these Terms.
